Fund-raising Hot Water
HB 694



In the past weeks, we have been running into many local leaders who are not aware of a new campaign finance law in Ohio that could potentially land you and your supporters in hot water. Take note of HB 694.

On December 20, 2006, the Ohio General Assembly passed Substitute House Bill 694, enacting broad changes to Ohio’s “pay-to-play” laws. The new law places significant restrictions on individual political contributors who hold, or hope to win, a contract with the state and local government.

Under the new law, if corporate owners, their spouses, and an affiliated political action committee contribute a collective total of more that $2,000.00 in a two year period, a ban against awarding contracts is triggered. Furthermore, no political subdivision may enter into a contract unless it includes a certification that the contractor has complied with this new law.

Although the legislation is no doubt well intended, it is important for all elected officials to understand and comply with this new law. Penalties for the vender can be as high as a $1,000.00 fine and termination of the contract.
